1. Contractual Relationship

These Terms constitute a legally binding agreement between you and NextRep. We reserve the right to suspend or terminate your access to the Services at any time, with or without notice, for any reason, including violation of these Terms.

2. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Services. By using the Services, you represent and warrant that you meet this requirement.

3. The Services

NextRep provides fitness-related tools, workout recommendations, tracking features, and related content designed to support fitness planning and progress tracking. The Services may change over time, and we do not guarantee that any particular feature will always be available.

4. License Grant

Subject to these Terms, NextRep grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for your personal, non-commercial use.

You may not:

• Copy, modify, or distribute the Services
• Reverse engineer or attempt to extract source code
• Use the Services for unlawful or abusive purposes
• Interfere with system security or functionality

5. Account Registration

You may be required to create an account using your email or third-party login providers (e.g., Apple, Google). You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

6. Subscriptions, Fees & Payments

Certain features of the Services may require a paid subscription or in-App purchase.

By purchasing a subscription:

• You authorize recurring billing through your app store provider
• Subscription fees are billed in advance
• Subscriptions automatically renew unless canceled
• Payments are non-refundable except where required by law

Cancellation must be completed through the platform where you subscribed (Apple App Store / Google Play Store).

7. User Content

You may submit content, including workout data, photos, or other materials ("User Content"). You retain ownership of your User Content, but grant NextRep a worldwide, royalty-free, non-exclusive license to use, store, display, modify, and process such content solely to provide and improve the Services.

You represent that you have all necessary rights to submit User Content and that it does not violate any laws or third-party rights.

8. Health & Safety Disclaimer

You acknowledge and agree that NextRep does not provide physical services and does not function as a personal trainer, fitness coach, or medical professional.

To the extent that NextRep offers workout routines, exercise suggestions, training plans, or fitness-related content that may be personalized to your goals, such content is provided for informational and educational purposes only.

You agree that following, adopting, or executing any workouts, exercises, or physical training routines is undertaken entirely at your own risk. Physical activity involves inherent risks, including injury or health complications.

You should consult a qualified fitness professional or healthcare provider before beginning any exercise program.

9. No Medical Advice

The Services do not provide medical advice, diagnosis, or treatment and do not establish a doctor-patient relationship. Always seek professional medical advice regarding any health concerns.

10. Disclaimers

The Services are provided "as is" and "as available", without warranties of any kind, express or implied. NextRep disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not guarantee any specific fitness results.

11. Limitation of Liability

To the maximum extent permitted by law:

• NextRep shall not be liable for indirect, incidental, or consequential damages
• NextRep's total liability shall not exceed the amount you paid to NextRep in the 12 months preceding the claim, or USD $100, whichever is greater

12. Indemnification

You agree to indemnify, defend, and hold harmless NextRep and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from:

• Your use of the Services
• Your User Content
• Your violation of these Terms
• Your violation of any law or third-party rights

13. Dispute Resolution & Governing Law

These Terms shall be governed by the laws of England and Wales, without regard to conflict of law principles.

Any disputes arising from these Terms or the Services shall be resolved exclusively in the courts located in England and Wales, unless otherwise required by law.

14. Changes to These Terms

We may update these Terms at any time. Continued use of the Services after changes become effective constitutes acceptance of the revised Terms.
